National Emission Standards for Hazardous Air Pollutants:
Industrial, Commercial, and Institutional Boilers Area Sources
                                Subpart JJJJJJ (“6J”)

On February 21, 2011, the US Environmental Protection Agency promulgated new National Emission Standards for Hazardous Air Pollutants (NESHAP) for Industrial, Commercial, and Institutional Boilers at Area Sources (40 CFR Part 63, Subpart JJJJJJ or 6J). The rule affects boilers that burn coal, oil, or biomass materials located at minor or area sources that emit hazardous air pollutant(s) (“HAP”). Existing facilities subject to this regulation are required to: 
    • submit an initial notification no later than September 17, 2011; and 
    • comply with certain emission limits, work practice standards, emission reduction    
        measures, and management practices listed in the regulation as soon     
        March 21, 2012.
New facilities are required to comply upon startup of affected units.

A HAP area source means any stationary source that emits or has the controlled potential to emit, in the aggregate, less than 10 tons per year of any single HAP or less than 25 tons per year of any combination of HAPs.
