City withdraws one of its claims against airport legislation

The City of Charlotte has withdrawn its claim that the airport legislation unconstitutionally affected certain contracts.  As a result, the December 11 court hearing has been cancelled.  According to City Attorney Bob Hagemann, “we concluded that this claim is not necessary for the City to achieve its objectives.  We always try to focus litigation on the major issues to dispute. The City’s claim that the legislation is unconstitutional for failing to recognize the role of the Federal Aviation Administration has yet to be decided by the court. No other hearing is scheduled at this time.
